Wix App Market Application
Terms and Conditions
Effective Date: 7 April 2026
These Terms and Conditions ("Terms") govern your access to and use of KnowIt (the "App"), a quiz-creation and engagement platform published on the Wix App Market by Digital Vision ("we", "us", or "our"). By installing or using the App, you ("User") agree to be bound by these Terms. If you do not agree, you must not install or use the App.
These Terms should be read alongside the Wix App Market Terms of Service and our Privacy Policy, both of which are incorporated by reference.
1. Definitions
"App"
The KnowIt application and all associated services, features, and content made available through the Wix App Market.
"User" / "you"
Any individual or legal entity that installs or uses the App on a Wix site.
"Site Visitor"
Any end-user who interacts with a quiz embedded on your Wix website via the App.
"Content"
All quizzes, questions, answers, prize descriptions, images, and other material you create, upload, or store using the App.
"User Data"
Information collected about Site Visitors, including quiz responses, scores, and leaderboard entries.
"Free Plan"
The no-charge tier of the App providing limited features as described in Section 4.
"Premium Plan"
The paid subscription tier of the App providing extended features as described in Section 4.
"AI Generation"
The feature that uses the Claude API (Anthropic) to generate quiz questions, available on the Premium Plan with a user-supplied API key.
"BYOK"
Bring Your Own Key — the requirement that Users supply their own Anthropic API key to use the AI Generation feature.
2. Acceptance of Terms
By clicking "Install", "Add to Site", or otherwise accessing the App, you confirm that:

You are at least 18 years of age or the age of legal majority in your jurisdiction.

You have the authority to bind your organisation (if applicable) to these Terms.

You have read and understood these Terms in full.

You accept and agree to comply with these Terms and all applicable laws.
We reserve the right to update these Terms at any time. Continued use of the App after notification of changes constitutes acceptance of the revised Terms.
3. Licence
3.1 Grant of Licence
Subject to your compliance with these Terms and payment of any applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable licence to install and use the App on Wix websites that you own or operate, solely for your own internal business purposes.
3.2 Restrictions
You must not:

Sublicence, sell, resell, transfer, or assign the App or your rights under these Terms.

Modify, adapt, translate, reverse-engineer, decompile, or disassemble the App.
-
Use the App to create a competing product or service.
-
Remove or alter any proprietary notices, labels, or marks on the App.
-
Use the App in any way that violates applicable law or these Terms.
4. Plans, Features & Pricing
4.1 Free Plan
The Free Plan includes the following features at no charge:

Basic analytics
We reserve the right to modify Free Plan limits on 30 days' notice.
4.2 Premium Plan
The Premium Plan (currently £9.00/month for consumer use; £29.00/month for agency use) includes all Free Plan features plus:

Unlimited quizzes and questions

All three quiz modes: Guided, Exam, and Competitive

Configurable leaderboard (Top 5 to Top 100)

Prize and competition management
-
AI quiz generation (BYOK — see Section 7)

Attempt limits and quiz scheduling

Full analytics with participant actions
Prices are quoted exclusive of any applicable taxes (including VAT). You are responsible for any taxes applicable in your jurisdiction.
4.3 Billing & Renewal
Premium Plan subscriptions are billed monthly in advance through the Wix App Market billing system. Subscriptions renew automatically unless cancelled before the next renewal date. Refunds are subject to the Wix App Market refund policy.
4.4 Free Trial
We may offer a free trial of the Premium Plan at our discretion. At the end of any trial period, your subscription will automatically convert to the paid Premium Plan unless cancelled.
5. User Content & Responsibilities
5.1 Your Content
You retain all intellectual property rights in the Content you create using the App. You grant us a limited, royalty-free, worldwide licence to host, store, and process your Content solely as necessary to provide the App's services.
5.2 Content Standards
You are solely responsible for all Content you create, publish, or distribute via the App. You must not create or publish Content that:

Violates any applicable law or regulation.

Infringes the intellectual property rights of any third party.
-
Is defamatory, obscene, offensive, hateful, or discriminatory.
-
Is misleading, deceptive, or likely to confuse Site Visitors.
-
Promotes illegal activities or contains malware.
-
Violates any third-party terms of service (including Wix's Terms of Service).
5.3 Prize & Competition Content
If you use the App's competition and prize features, you are solely responsible for:

The accuracy and legality of any prizes you advertise.
-
Fulfilling all prizes awarded to Site Visitors.
-
Ensuring your competition complies with all applicable laws and regulations in your jurisdiction, including gambling, lottery, and promotional competition laws.
-
Providing accurate competition rules, terms, and any legally required disclaimers.
-
Collecting any necessary consents from prize winners.
We accept no liability for prizes advertised, awarded, or unfulfilled through the App. The built-in legal acknowledgement feature is provided as a convenience tool only and does not constitute legal advice.
5.4 Compliance with Consumer Laws
If your Wix website serves consumers, you are responsible for ensuring that any competitions, games of skill, or prize promotions you run via the App comply with the UK Consumer Rights Act 2015, CAP Code, and any other applicable legislation.
6. User Data, Privacy & GDPR
6.1 Data You Collect
By using the App, you may collect User Data from Site Visitors, including names, email addresses (if entered), quiz responses, and scores. You are the Data Controller in respect of any personal data collected from Site Visitors. We act as a Data Processor on your behalf.
6.2 Your Obligations as Data Controller
You must:

Maintain a compliant Privacy Policy on your Wix website that accurately describes your data collection practices.

Have a lawful basis for processing any personal data collected via the App.
-
Obtain any required consents from Site Visitors before collecting their data.
-
Respond to data subject access requests and other rights under the UK GDPR / EU GDPR within the required timeframes.

Notify us promptly of any data breach involving User Data.
6.3 Data We Collect
We collect and process the following categories of data to provide the App:

Account information provided to us or Wix (business name, email address).
-
Quiz configuration data (quiz structure, questions, settings).
-
Aggregated and anonymised analytics data to improve the App.
-
Technical data (device type, browser, App usage logs).

6.4 Data Retention
Leaderboard scores and quiz result data are stored persistently to enable the "returning visitor" and personal best features. You may delete individual quiz results or entire quiz datasets from your dashboard at any time. On termination of your account, all User Data will be deleted within 30 days, except where retention is required by law.
6.5 Data Security
We implement appropriate technical and organisational security measures to protect User Data. However, no system is completely secure, and we cannot guarantee the absolute security of data transmitted over the internet.
7. AI Quiz Generation Feature
7.1 BYOK Requirement
The AI Generation feature requires you to supply your own Anthropic API key ("BYOK"). Your use of this feature is subject to Anthropic's Terms of Service and Usage Policies in addition to these Terms. We are not affiliated with Anthropic and make no warranty regarding the availability or performance of the Anthropic API.
7.2 API Key Security
You are solely responsible for the security and confidentiality of your Anthropic API key. You must not share your API key with third parties or embed it in publicly accessible code. We store your API key securely and use it solely to make authorised API requests on your behalf within the App.
7.3 Generated Content
Content generated via the AI Generation feature is produced by a third-party AI model and may occasionally contain inaccuracies, errors, or inappropriate material. You are responsible for reviewing and editing all AI-generated questions before publishing them. We make no warranty as to the accuracy, quality, or appropriateness of AI-generated content.
7.4 Cost of API Usage
You are responsible for all costs incurred by your Anthropic API key usage. We recommend monitoring your API usage through Anthropic's dashboard to avoid unexpected charges.
8. Intellectual Property
The App, including its design, code, features, and branding (the "KnowIt IP"), is owned by Digital Vision and protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers ownership of the KnowIt IP to you.
The "KnowIt" name and logo are trademarks of Digital Vision. You may not use our trademarks without our prior written consent.
If you provide feedback, suggestions, or ideas about the App, you grant us an irrevocable, worldwide, royalty-free licence to use that feedback without restriction or compensation to you.
9. Availability & Service Levels
We aim to provide the App with reasonable availability but do not guarantee uninterrupted access. The App is provided via the Wix App Market infrastructure and is subject to Wix's own availability commitments. We reserve the right to:

Take the App offline for maintenance, with reasonable notice where practicable.
-
Modify, suspend, or discontinue any feature with 30 days' notice.
-
Terminate the App entirely with 60 days' notice, after which all data will be deleted.
10. Acceptable Use Policy
You agree not to use the App to:
-
Transmit spam, unsolicited messages, or conduct phishing campaigns.
-
Collect personal data from minors under the age of 13 (or applicable local age threshold) without parental consent.
-
Run competitions that constitute illegal gambling or unlicensed lotteries.
-
Impersonate any person or entity, or misrepresent your affiliation with any organisation.
-
Attempt to gain unauthorised access to the App, its servers, or any related systems.
-
Introduce viruses, trojans, or other malicious code.
-
Scrape, harvest, or systematically download data from the App.
-
Use the App in any way that causes damage to us, Wix, Site Visitors, or any third party.
Breach of this Acceptable Use Policy may result in immediate suspension or termination of your access to the App.
11. Disclaimers & Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
-
Warranties that the App will meet your specific requirements.
-
Warranties that the App will be uninterrupted, timely, secure, or error-free.
-
Warranties regarding the accuracy or reliability of any results obtained via the App.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.
12. Limitation of Liability
To the fullest extent permitted by applicable law:

Our total aggregate liability to you for all claims arising under or in connection with the App will not exceed the total fees paid by you in the 12 months preceding the claim.

We will not be liable for any indirect, incidental, consequential, punitive, or exemplary damages, including loss of profits, revenue, data, goodwill, or business opportunity.

We are not liable for any failure to perform our obligations due to causes outside our reasonable control (force majeure).
You acknowledge that the fees paid for the App reflect the allocation of risk set out in these Terms and that we would not have entered into these Terms without these limitations.
13. Indemnification
You agree to indemnify, defend, and hold harmless Digital Vision and its officers, directors, employees, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from or relating to:

Your use of the App.

Your Content, including any competition, prize, or quiz you publish.

Your breach of these Terms.
-
Your violation of any applicable law.
-
Any claim by a Site Visitor arising from a quiz or competition you have operated.
14. Termination
14.1 Termination by You
You may terminate your use of the App at any time by uninstalling it from your Wix site. Termination does not entitle you to a refund of any prepaid fees.
14.2 Termination by Us
We may suspend or terminate your access to the App immediately, without prior notice or liability, if:

You breach these Terms and fail to remedy the breach within 7 days of written notice.
-
You repeatedly or materially breach the Acceptable Use Policy.
-
We are required to do so by law, court order, or regulatory authority.
-
We have reasonable grounds to suspect fraudulent activity.
14.3 Effect of Termination
On termination of your account for any reason: (a) all licences granted to you under these Terms will cease; (b) you must cease all use of the App; (c) we will delete your Content and User Data within 30 days. Clauses that by their nature should survive termination (including Sections 8, 11, 12, 13, and 16) will continue to apply.
15. Third-Party Services
The App operates within the Wix ecosystem and may integrate with third-party services, including:

Wix (platform infrastructure, billing, authentication)

Anthropic (AI quiz generation — BYOK only, Section 7)
We are not responsible for the availability, accuracy, or policies of any third-party services. Your use of third-party services is governed by their respective terms and privacy policies.
16. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Before initiating formal proceedings, you agree to contact us to seek an amicable resolution. Please direct all legal notices to the contact address below.
17. General Provisions
Entire Agreement. These Terms, together with our Privacy Policy and any applicable order confirmations, constitute the entire agreement between you and us regarding the App and supersede all prior agreements.
Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
No Waiver. Failure to enforce any provision of these Terms on one occasion does not waive our right to enforce it on any future occasion.
Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations to a successor entity on written notice to you.
Notices. All notices to us must be sent to the contact address below. We will send notices to the email address associated with your Wix account.
Language. These Terms are written in English. Any translated version is provided for convenience only; the English version prevails in the event of any conflict.

Privacy Policy

Who This Policy Is For
This Privacy Policy is published by Digital Vision (“we”, “us”, “our”), the developer and publisher of the KnowIt application on the Wix App Market.
This policy governs how we process personal data that we directly collect and control. It applies to:

Wix site owners who install the KnowIt App (“App Users”).

Visitors to our website or anyone who contacts us directly.
Important: What this policy does NOT cover
This policy does not govern personal data that App Users collect from their own website visitors (“Site Visitors”) via quizzes embedded on their Wix sites.
App Users are independently responsible as Data Controllers for any personal data they collect from Site Visitors. Digital Vision processes that data strictly as a Data Processor acting on the App User’s instructions.
App Users must maintain their own Privacy Policy on their Wix site that discloses their data collection practices to Site Visitors. Digital Vision accepts no liability for an App User’s failure to do so.
1. Data Controller Identity
For personal data collected directly from App Users, Digital Vision is the Data Controller within the meaning of UK GDPR Article 4(7) and the Data Protection Act 2018.
For personal data that App Users collect from Site Visitors using the App, Digital Vision acts solely as a Data Processor (UK GDPR Art. 4(8)) on the App User’s instructions. The App User remains the Data Controller and bears full legal responsibility for that data.
Contact details for data protection enquiries are set out in Section 12.

We do not collect special category data (UK GDPR Art. 9) from App Users.
3. Our Role as Data Processor for Site Visitor Data
When an App User’s Site Visitors interact with quizzes embedded on the App User’s Wix site, the App may process the following categories of data strictly on the App User’s behalf:

Quiz responses and selected answers

Scores, pass/fail outcomes, and attempt timestamps

Leaderboard display names (if the App User enables the leaderboard)

Anonymous session tokens (to identify returning visitors for personal best tracking)

Attempt counts and scheduling eligibility flags
We process this data only as instructed by the App User, only to the extent necessary to deliver the App’s features, and never for our own independent purposes.
Our obligations as Data Processor are governed by the Data Processing Agreement (“DPA”) incorporated into our Terms and Conditions. In summary:

We process Site Visitor data only on documented instructions from the App User.

We implement appropriate technical and organisational security measures.
-
We do not engage sub-processors without the App User’s general authorisation (sub-processors are listed in Section 6).

We assist App Users in meeting their own UK GDPR obligations, including data subject rights requests, within reasonable timeframes and subject to our standard support SLA.

On termination of the App User’s account, we delete all Site Visitor data within 30 days unless legally required to retain it.
4. How We Use App User Personal Data

We do not use App User personal data for advertising, third-party marketing, or automated decision-making that produces legal or similarly significant effects.
5. Legal Bases for Processing
Contract performance (Art. 6(1)(b)): The majority of our processing is necessary to deliver the App under our Terms and Conditions — account management, billing, AI generation, and core features.
Legitimate interests (Art. 6(1)(f)): We rely on legitimate interests for security monitoring, fraud prevention, error logging, and anonymised product analytics. We have conducted a Legitimate Interests Assessment and concluded these interests are not overridden by App Users’ rights and freedoms.
Legal obligation (Art. 6(1)(c)): We retain billing records for 7 years to comply with HMRC requirements and respond to lawful requests from regulators or courts.
Consent (Art. 6(1)(a)): Where we rely on consent (for example, optional marketing communications), you may withdraw at any time by contacting us. Withdrawal does not affect the lawfulness of prior processing.
6. How We Share Personal Data
6.1 We Do Not Sell Personal Data
Digital Vision does not sell, rent, trade, or otherwise transfer personal data to third parties for commercial gain. Ever.
6.2 Sub-processors
We share personal data with the following sub-processors who process data on our behalf under binding data processing agreements:

6.3 Legal Disclosures
We may disclose personal data where required by law, court order, or a competent regulatory authority. We will notify you before making such a disclosure where legally permitted to do so.
6.4 Business Transfers
In the event of a merger, acquisition, or sale of Digital Vision, personal data may transfer to a successor entity. We will provide at least 30 days’ notice via email and in-App notification before data is transferred to a new controller, allowing you to close your account and request deletion if you do not wish to continue.
7. International Data Transfers
We primarily process and store data within the United Kingdom and European Economic Area. Where transfers outside the UK/EEA are necessary (for example, for cloud infrastructure or certain support tools), we rely on one or more of the following safeguards:

UK adequacy regulations or EU Commission adequacy decisions.

UK International Data Transfer Agreements (IDTA) or Standard Contractual Clauses (SCCs).

Binding Corporate Rules approved by a competent supervisory authority.
Details of the specific mechanism used for any given transfer are available on request.
8. Data Retention

9. Security
We implement appropriate technical and organisational measures to protect personal data commensurate with the risk, including:

Encryption of all data in transit (TLS 1.2 or higher) and at rest.
-
Role-based access controls restricting data access to authorised personnel only.
-
Regular security testing and vulnerability assessments.
-
Incident response procedures aligned with UK GDPR notification obligations.
In the event of a personal data breach that poses a risk to individuals’ rights and freedoms, we will notify the ICO within 72 hours and notify affected App Users without undue delay. Where the breach involves Site Visitor data, we will provide App Users with all information reasonably required to fulfil their own notification obligations.
Breach responsibility — how liability is allocated
Digital Vision is responsible for breaches caused by failures in our own systems, infrastructure, or personnel.
App Users are responsible for breaches caused by their own configuration choices, misuse of the App, failure to maintain secure credentials, or their own systems.
Our total liability for any breach is limited as set out in the Terms and Conditions. App Users should maintain appropriate cyber liability insurance covering their role as Data Controller.
10. App User Rights Under UK GDPR
As a Data Subject in relation to the personal data we hold about you (App User account data), you have the following rights:

Request correction of inaccurate or incomplete data. Much account data can be updated directly in your Wix account settings.

Request deletion of your personal data. Note: billing records are retained for 7 years as required by law.
Restriction (Art. 18)
Request that we limit processing in certain circumstances (e.g. while accuracy is disputed).
Portability (Art. 20)
Receive your personal data in a structured, machine-readable format. Available for data processed by automated means on the basis of contract or consent.
Object (Art. 21)
Object to processing based on legitimate interests. We will cease unless we can demonstrate compelling legitimate grounds.
Withdraw consent
Where processing is consent-based, withdraw at any time without affecting prior processing.
To exercise any right, contact us at the details in Section 12. We will respond within one calendar month, extendable by two further months for complex requests. We may ask you to verify your identity before fulfilling a request. Requests are free of charge unless manifestly unfounded or excessive.
If you are dissatisfied with our response, you have the right to complain to the Information Commissioner’s Office (ICO) at ico.org.uk or on 0303 123 1113.
11. Children’s Data
The KnowIt App is designed for use by business owners aged 18 or over. We do not knowingly collect personal data from anyone under 18 as an App User.
App Users who operate websites that may be accessed by children are independently responsible as Data Controllers for complying with:

The ICO’s Age Appropriate Design Code (Children’s Code) for services directed at users under 18.
-
Any requirement to obtain verifiable parental consent before processing data of children under 13.
-
COPPA if the App User’s site is directed at children under 13 in the United States.
If we become aware that a child under 13 has provided us with personal data directly (as an App User), we will delete it promptly. Please contact us if you have reason to believe this has occurred.
12. Changes to This Policy
We may update this Privacy Policy from time to time. For material changes, we will provide at least 14 days’ advance notice via email to the address associated with your account and/or a prominent in-App notice. The effective date at the top of this policy will be updated accordingly.
Your continued use of the App after the effective date of a revised policy constitutes acceptance. If you do not accept the revised policy, you must stop using the App and may close your account.
