Terms of Service

These Terms of Service ("Terms") govern your use of applications developed and published by We Are Digital Vision ("we", "us", "our"), including MomenTik, Creator Hub, KnowIt, Rollover Image Effects, and Button Magic (collectively, "our Apps"), as well as our website at wearedigitalvision.com.

By installing or using any of our Apps, you agree to be bound by these Terms. If you do not agree, do not install or use our Apps.

1. Overview of Services

Our Apps are published on the Wix App Market and are designed to enhance the functionality of Wix websites. Each App provides specific features as described in its App Market listing. Our Apps may integrate with third-party services at your direction.

MomenTik specifically provides AI-powered content generation and TikTok integration services for Wix site owners. MomenTik analyses your Wix site content, generates TikTok slideshow content using AI, and uploads approved content to your TikTok drafts for your review and publication.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use our Apps. By using our Apps, you represent that you meet this requirement and have the authority to bind yourself to these Terms.

3. Account and Access

3.1 Wix Account

Our Apps operate within the Wix platform. You must have a valid Wix account to install and use our Apps. Your Wix account is governed by Wix's own Terms of Use.

3.2 Third-Party Accounts

Certain Apps may require you to connect third-party accounts (such as TikTok). When you connect a third-party account:

  • You authorise us to access and use that account on your behalf, solely for the purposes described in the App

  • You are responsible for maintaining the security of your third-party account credentials

  • You may disconnect a third-party account at any time through the App's settings

  • You remain bound by the third-party platform's own terms of service

3.3 API Keys

Certain Apps may require you to provide your own third-party API keys (such as an Anthropic Claude API key). When you provide an API key:

  • You are solely responsible for any costs incurred through the use of that API key

  • You warrant that you have the right to use the API key for the purposes enabled by our App

  • We encrypt and store your API key securely and use it only to provide the service you have requested

  • You may remove your API key at any time through the App's settings

4. Acceptable Use

You agree not to use our Apps to:

  • Violate any applicable law, regulation, or third-party rights

  • Generate, distribute, or post content that is illegal, defamatory, obscene, or infringes on intellectual property rights

  • Spam, mislead, or deceive others

  • Impersonate any person or entity

  • Interfere with or disrupt the operation of our Apps, the Wix platform, or any third-party service

  • Attempt to gain unauthorised access to any system or data

  • Use automated means to interact with third-party platforms in violation of their terms of service

  • Generate or post content that violates TikTok's Community Guidelines or Terms of Service

You are solely responsible for all content generated through and posted via our Apps. While our Apps may use AI to generate content suggestions, you are responsible for reviewing, approving, and publishing that content.

5. Content and Intellectual Property

5.1 Your Content

You retain ownership of all content from your Wix site and any content you create, modify, or approve within our Apps. By using our Apps, you grant us a limited, non-exclusive licence to process your content solely for the purpose of providing our services.

5.2 AI-Generated Content

Content generated by AI through our Apps is produced using your own API key and your own site data. You are responsible for reviewing all AI-generated content before it is posted to any platform. We make no warranties regarding the accuracy, originality, or suitability of AI-generated content.

5.3 Our Intellectual Property

Our Apps, including their design, code, features, and documentation, are owned by We Are Digital Vision and are protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer our Apps.

6. Third-Party Services

Our Apps integrate with third-party services including, but not limited to, Wix, TikTok, and Anthropic. We are not responsible for:

  • The availability, accuracy, or reliability of third-party services

  • Changes to third-party APIs, terms, or policies that may affect our Apps

  • Content moderation decisions made by third-party platforms

  • Any loss or damage arising from your use of third-party services

Your use of third-party services is governed by their respective terms of service and privacy policies. It is your responsibility to comply with the terms of all third-party services you use through our Apps.

6.1 TikTok-Specific Terms

When using MomenTik's TikTok integration:

  • You are responsible for complying with TikTok's Terms of Service and Community Guidelines

  • Content uploaded to your TikTok drafts is subject to TikTok's content moderation policies

  • You must review and approve all content before publishing it on TikTok

  • TikTok may restrict or remove content that violates their policies; we are not liable for such actions

  • We do not guarantee that content will be accepted, published, or promoted by TikTok

7. Subscriptions and Payment

7.1 Free Trial

Certain Apps may offer a free trial period. During the trial, all features are available without charge. At the end of the trial period, continued use of paid features requires an active subscription.

7.2 Pricing

Subscription pricing is displayed in the App and on the Wix App Market listing. Prices are in GBP unless otherwise stated. We reserve the right to change pricing with 30 days' notice.

7.3 Billing

Payments are processed through the Wix platform. By subscribing, you authorise Wix to charge your payment method on a recurring basis. Subscription management (cancellation, upgrades, downgrades) is handled through your Wix account.

7.4 Refunds

Refund requests are handled in accordance with Wix's refund policies. If you believe you are entitled to a refund, contact us at info@wearedigitalvision.com.

7.5 Third-Party Costs

Certain features may incur costs from third-party providers (such as AI API usage charges). These costs are your responsibility and are billed directly by the third-party provider. We do not control, set, or collect third-party usage fees.

8. Disclaimers

8.1 "As Is" Provision

Our Apps are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

8.2 No Guarantee of Results

We do not guarantee that our Apps will achieve any specific outcome, including but not limited to increased followers, views, engagement, or revenue on any platform.

8.3 AI Limitations

AI-generated content may contain errors, inaccuracies, or content that is unsuitable for your purposes. You must review all AI-generated content before use or publication.

8.4 Service Availability

We do not guarantee uninterrupted or error-free operation of our Apps. We may perform maintenance, updates, or modifications that temporarily affect availability.

9. Limitation of Liability

To the maximum extent permitted by law:

  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Apps

  • Our total liability for any claim arising from these Terms shall not exceed the total amount paid by you to us in the 12 months preceding the claim

  • We shall not be liable for any loss or damage arising from third-party services, including TikTok content moderation decisions, API changes, or service outages

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

10. Indemnification

You agree to indemnify and hold harmless We Are Digital Vision and its directors, officers, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:

  • Your use of our Apps

  • Content you generate, approve, or publish through our Apps

  • Your violation of these Terms

  • Your violation of any third-party rights or terms of service

11. Termination

11.1 By You

You may stop using our Apps at any time by uninstalling them from your Wix site. Uninstallation terminates your access to the App and triggers deletion of your data in accordance with our Privacy Policy.

11.2 By Us

We may suspend or terminate your access to our Apps if:

  • You breach these Terms

  • Your use of our Apps poses a security risk or may harm other users

  • We are required to do so by law

  • We discontinue the App

We will provide reasonable notice where possible before termination, except where immediate action is required.

12. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top indicates when these Terms were last revised. Continued use of our Apps after changes constitutes acceptance of the revised Terms. Material changes will be communicated through the App dashboard or via email.

13. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and We Are Digital Vision regarding your use of our Apps.
